Terms of Service

Important Notes:

• I have the right to alter these terms at any point. Though changes made will not affect clients who have already accepted previous terms.

  • Unless the change was deemed necessary to protect the safety of any persons involved.

• I will not accept commissions over $30 from people under the age of 18.

• If a chargeback is made you will be permanently black listed from my commission queue, and a dispute will be opened.

Commissions formatting:

If you want your commission in a specific format please specify that at the start! Otherwise I will make it in my usual 5x7” canvas (good for small prints), or a traditional desktop resolution of 1920x1080p canvas depending on the piece.

Commission Process What To Expect:

• After I accept your commission I will add it to my accepted queue.

• For non stream slots payment is expected in full within 5 days of accepting your slot. It must be paid before I will start on your commission. (unless otherwise discussed and agreed upon.) I do not send invoices as I do not have a business specific paypal yet.

• If it is your turn and you have not paid I will message you ONCE concerning your missing payment and move onto the next paid slot on the list before coming back to yours. So immediate payment is most appreciated, and aids in a quick turnaround.

• Once paid I will mark you as paid, and start on your commission when your turn is up. (a trello or other location for viewing the queue is coming in the future)

  • After I start on your commission I will send you a rough sketch when it's made. This is where you can request changes. (significant changes outside of the agreed upon commission description could warrant additional cost).

    • After the sketch is approved I will move on with finishing your commission.

      • Additional previews may be shared as deemed necessary, or upon request if reasonable.

Refunds:

• Refunds may be requested up until your commission has been started.

  • After it has been started partial refunds may be discussed if needed.

• Refunds may also be offered if something comes up and I don’t feel I’ll be able to complete your commission in a reasonable amount of time.

• If at any point you (the commissioner) exhibits rude, inappropriate, offensive, discriminatory, or threatening behavior towards myself or anyone else. I reserve the right to offer full or partial refunds and not complete the commission. (partial refund is if the commission has already been started). This is further covered in the “refusal and termination of service” section.

Usage Rights:

• All commissioned works are for private, non-commercial use only! Unless otherwise discussed and agreed upon!

  • This means you cannot turn this artwork into things to sell. Such as stickers, shirts, and prints/cards etc..

  • I AM open to making an agreement if this is something you want to do. But you MUST TALK TO ME FIRST BEFORE MAKING ANY MONEY FROM MY ART DIRECTLY!

  • This does not include using the artwork for things like a Youtube or Twitch profile pictures or emotes.

  • You may get prints for personal use, or to hand out for free. But no money is to be made.

• You may repost your commission, but you may NOT remove my signature or watermark, if applicable. I do ask that you credit me on the post.

  • Please DO NOT tag me directly if there is any NSFW content also on the post you are sharing. Please use the credit method of @/ItsFizActually in that situation.

• Do not make alterations to the final artwork without seeking my approval first!

  • Memes are fine, but seriously trying to change the artwork is not. Such as changing your markings or adding/changing clothing.

• I retain all rights and ownership over the commissioned artwork. This includes the right to redistribute, promote, or profit from the commissioned artwork.

  • Mostly referring to my right to repost the artwork on various platforms. Or use it as an example for future commissions.

  • Commissioning me does NOT give me rights to YOUR sona or original character. Simply rights to the specific artwork I (the artist) created of said character.

• If you wish for me to not share, or wait to share, your piece on my social media please specify in advance.

Refusal and Termination of Service:

• I have the right to refuse or terminate a commission for any reason.

  • (see refund section for partial/full refund policy)

  • Reasons for refusal or termination include but are not limited to

    • Failure to adhere to the TOS.

    • Rude, inappropriate, offensive, discriminatory, or threatening behavior in or outside of the commission communication.

    • Being overly difficult to work with.

    • I am likely to not accept your commission if it is exceedingly specific in its exact details, as this is not enjoyable for me at all.

• Further reasons for termination may simply include my inability to complete a commission, which has been previously covered in the refund policy.

• As previously stated in the refund policy, any termination of services mid-commission (regardless of reason) is subject to a PARTIAL refund. Any work done up to that point may or may not be sent to you depending on the reason the commission was terminated. Which will factor into how much of a refund will be given. Full refunds after work has started will only occur if I (the artist) deem it fair and necessary.

  • The most likely causes for a mid-commission termination without receiving the work done up to that point would include but are not limited to things like:

    • Discovering you are selling artwork without the permission of the artist. Whether or not that artist is me.

    • Discovering you are not 18+ for commissions over $30.

    • You have been found to be stealing artwork. (such as tracing and reselling)

    • It is found you have broken the TOS.

Discord Commission Policy:

To keep commissioning more accessible since Bluesky does not have images in DMs yet, and for those who do not like using social media to communicate for commission purposes, I will do my best to continue to accept discord DMs as a way to commission me.

Discord can be used for commissioning purposes if you:

• Do not edit messages pertaining to the commission after I have responded/reacted to that message.

  • If you do so I am not responsible for significant changes without charging you, even if the details I missed are listed in the edited message. I have no way of checking what was changed, or if you are trying to scam me. All I can see is the time/date it was changed. Therefore I WILL know if you edited it after I have responded to that message.

  • If you missed something just simply send it as another message. This makes things easier for everyone. I’m also much more likely to work with the changes, potentially without charging, because I appreciate your cooperation and respect. 

• Please do not add me as a friend just to ask about commissions. You can message people without sending a friend invite.
